Terms of Use & Platform Policy
1. Acceptance of Terms
By using MaRquM AI, you agree to comply with these Terms of Use and Platform Policy. If you do not agree, you must not use the platform.
2. Nature of the Service
MaRquM AI provides AI-powered tools for analyzing documents, generating content, and building AI assistants. The platform is provided as a productivity and assistance tool only.
- We do not guarantee that AI outputs are always accurate, complete, or suitable for a specific purpose.
- The platform is not a replacement for legal, financial, medical, accounting, tax, or professional advice.
- You are responsible for reviewing and validating all outputs before using them.
3. User Responsibility
You are fully responsible for the content you upload, the permissions related to that content, and your use of any generated results.
- You must not upload illegal, harmful, confidential, stolen, or copyrighted content without permission.
- You must not use the platform to generate unlawful, misleading, abusive, fraudulent, or harmful material.
- You must not attempt to exploit, overload, copy, reverse engineer, or interfere with the platform.
4. AI-Generated Content Disclaimer
All generated outputs are produced by artificial intelligence and may contain mistakes, omissions, or unsupported conclusions. You use the outputs at your own risk.
5. Account Suspension and Access
Digitalized Horizon Tech reserves the right to suspend, limit, or terminate any account, subscription, affiliate account, or access to the platform if we believe there is misuse, fraud, abuse, legal risk, violation of these terms, or harm to the platform or other users.
6. Subscription and Billing
Access to paid features depends on an active subscription. Manual payment proofs are subject to review and approval. Expired or rejected subscriptions may restrict access automatically.
7. Affiliate Program
The affiliate program is optional and may be changed, suspended, or discontinued at any time. Digitalized Horizon Tech may adjust commissions, reject suspicious commissions, delay payouts for review, or suspend affiliate accounts in cases of abuse, fraud, policy violations, or operational need.
No guaranteed earnings are promised under the affiliate program.
7.1 Affiliate Disclosure & Transparency
Affiliates must clearly and conspicuously disclose their relationship with MaRquM and Digitalized Horizon Tech on any website, social media post, email, or other channel where they promote MaRquM. Disclosures must be placed near any affiliate link or endorsement and must state that the affiliate may receive compensation for purchases made through their links. This is required for compliance with consumer protection laws, including FTC guidelines and Jordanian regulations.
7.2 Prohibited Marketing Activities
Affiliates are strictly prohibited from engaging in any of the following activities:
- Spam or Unsolicited Communications: Sending bulk emails, messages, or comments without proper consent or legal basis.
- Misleading or False Claims: Making exaggerated, false, or unsubstantiated claims about MaRquM's features, pricing, or capabilities.
- Brand Bidding on Paid Ads: Using MaRquM, Digitalized Horizon Tech, or any variation as keywords for paid search or display advertising without explicit written permission.
- Cookie Stuffing or Tracking Manipulation: Artificially generating clicks, impressions, or conversions through automated means, scripts, or fraudulent techniques.
- Unauthorized Discounts or Coupons: Offering, creating, or distributing discount codes or special offers not explicitly provided by MaRquM for affiliate use.
- Content on Prohibited Platforms: Promoting MaRquM on websites or channels that contain hate speech, violence, illegal content, sexually explicit material, or infringing intellectual property rights.
- Impersonation: Creating fake reviews, testimonials, or falsely representing an affiliation with MaRquM beyond the standard affiliate relationship.
7.3 Fraudulent or Invalid Referrals
The following types of referrals are considered invalid and will not earn commissions:
- Self-Referrals: Using your own affiliate link to purchase subscriptions for yourself or your immediate family members.
- Bot or Automated Traffic: Leads generated by automated bots, scripts, or any non-human means.
- Non-Genuine Purchases: Referred users who subscribe without genuine interest or who cancel within 30 days.
- Incentivized Signups: Offering cash, gifts, or other incentives to users in exchange for clicking your affiliate link or signing up.
- Duplicate or Manipulated Leads: Artificially inflating referral numbers through repeated clicks from the same device, IP address, or user.
- Unauthorized Payment Methods: Transactions involving stolen credit cards, chargebacks, or disputed payments.
7.4 Commission Structure & Payment Terms
Commissions are earned only on qualified, paid subscriptions that remain active beyond any applicable trial or refund period. We reserve the right to adjust commission rates, minimum payout thresholds, and payment schedules at any time with or without notice. Affiliates are responsible for ensuring their payment information is accurate and up to date. Payouts may be delayed or withheld pending review of suspicious activity.
7.5 Refunds, Chargebacks, and Commission Clawback
If a referred customer requests a refund, initiates a chargeback, or cancels their subscription within thirty (30) days of the original purchase, the associated commission will be reversed or deducted from future payouts. MaRquM reserves the right to recover any commissions already paid on transactions that are subsequently refunded, charged back, or determined to be fraudulent. Affiliates with excessive refund or chargeback rates may be removed from the program.
7.6 Commission Forfeiture & Account Termination
If your affiliate account is terminated due to violation of these terms, fraud, abuse, or any prohibited activity, you will forfeit all unpaid and pending commissions. No compensation will be paid after termination for any reason. You must immediately cease all promotional activities and remove any affiliate links or MaRquM branding from your channels upon termination.
7.7 No Guaranteed Earnings
MaRquM does not guarantee any minimum or specific level of earnings through the Affiliate Program. Your success depends entirely on your own marketing efforts, audience, and other factors outside our control. Past earnings are not indicative of future results.
7.8 Right to Modify or Terminate Program
Digitalized Horizon Tech reserves the right to modify, suspend, or terminate the entire Affiliate Program or any individual affiliate account at any time, for any reason, with or without notice. This includes changes to commission rates, payment schedules, tracking mechanisms, and eligibility criteria. Continued participation in the program after changes are posted constitutes acceptance of the modified terms.
7.9 Tax Responsibility
Affiliates are solely responsible for reporting and paying any taxes, fees, or levies applicable to commissions earned under this program based on their jurisdiction. Digitalized Horizon Tech will not withhold or pay taxes on behalf of affiliates unless required by law. You may be required to provide tax identification or registration information before receiving payouts.
7.10 Limitation of Liability for Affiliates
Digitalized Horizon Tech and MaRquM shall not be liable for any indirect, incidental, special, or consequential damages arising from your participation in the Affiliate Program, including lost profits, lost commissions, or business interruption. Our total liability to any affiliate shall not exceed the total commissions paid to that affiliate in the six months preceding any claim.
7.11 Governing Law for Affiliate Disputes
Any disputes arising under this Affiliate Program shall be governed by the laws of the Hashemite Kingdom of Jordan, without regard to conflict of law principles. Affiliates agree to submit to the exclusive jurisdiction of the courts located in Amman, Jordan for resolution of any such disputes.
8. Intellectual Property
MaRquM AI, its system, design, code, workflow, technology, branding, and platform structure are owned by Digitalized Horizon Tech. Users retain ownership of their uploaded content, subject to having the legal right to use it.
9. Data and Uploaded Content
By uploading content, you allow the platform to process that content for analysis, generation, assistant creation, preview, embed, and download features. You must not upload sensitive or restricted data unless you have the right and authority to do so.
10. Limitation of Liability
Digitalized Horizon Tech and MaRquM AI are not liable for losses, damages, business interruption, wrong decisions, legal issues, financial consequences, data loss, or third-party claims resulting from the use or misuse of the platform or AI-generated outputs.
11. Changes to Terms
We may update these terms at any time. Continued use of the platform means you accept the updated terms.
12. Governing Law
These terms are governed by the laws of the Hashemite Kingdom of Jordan.
13. Refund Policy
Because MaRquM provides immediate, non-cancellable services including document processing and AI-generated content, all payments are final and non-refundable. We do not provide partial or full refunds for any unused subscription period. If you experience a technical issue preventing you from using the service, please contact us at [your-email] and we will make reasonable efforts to resolve the issue, but this does not entitle you to a refund.
14. Data Retention & Account Deletion
Your data is retained while your account is active. Upon account deletion or subscription expiration, we may retain your data for up to 30 days before permanent deletion. You may request data deletion at any time via email. We are not responsible for recovering data after deletion.
15. Fair Use & Rate Limiting
MaRquM enforces fair usage limits based on your subscription plan. These limits include document counts, monthly assistant messages, and storage volume. Exceeding these limits may result in additional fees or temporary access restrictions. We monitor unusual usage patterns (such as automated requests or attempts to bypass limits) and reserve the right to restrict or terminate accounts that abuse the system.
16. User Indemnification
You agree to indemnify and hold harmless Digitalized Horizon Tech, its partners, and employees from any claims, losses, damages, costs (including attorney fees) arising from: (a) your uploaded content, (b) your use of the platform or its outputs, (c) your violation of these terms, or (d) your violation of any third-party rights.
17. Age Restrictions
Persons under the age of 13 are not permitted to use the platform. If you are between 13 and 18 years of age, you must have parental permission. We may collect minimal age verification information and may close accounts that violate this condition.
18. 'AS IS' Warranty Disclaimer
THE PLATFORM, OUTPUTS, AND AI ASSISTANTS ARE PROVIDED 'AS IS' AND 'AS AVAILABLE' WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES. WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR RELIABILITY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
19. Force Majeure
We are not liable for any delay or failure of performance resulting from causes outside our reasonable control, including but not limited to: service outages, internet attacks, third-party provider failures (including OpenRouter), natural disasters, war, or regulatory changes.
20. Class Action Waiver
You agree to bring any dispute on an individual basis, not as a plaintiff or class member in a class action or representative proceeding. You waive the right to participate in a class action against MaRquM or Digitalized Horizon Tech.
